Regulatory advice

We provide a full range of regulatory advice from initial consultation on the authorization required to the processing of applications for financial institutions and businesses of all sizes.

Our finance team can also notably be of assistance with the setting-up of a regulated financial entity by ensuring the compliance of the project with the Luxembourg legal and regulatory environment and providing guidance through the whole approval process. Furthermore, our finance team provides advice on the Payment Services Directive in respect of the regulation contained therein of payment services and payment service providers.

We also provide financial services regulatory advice relating to MNKS’ other practice areas including corporate and restructuring transactions, notably in the banking, private equity, outsourcing and e-commerce sectors, and relating to the various aspects of investment fund formation and regulation as well as assistance in addressing the requests emanating from the Luxembourg regulator

Private Banking

Our finance team assists our clients in all aspects of their ongoing relationship with their private banking clients and has notably a strong expertise in the drafting of the related contractual documentation (such as general terms and conditions, standard loan documentation, fiduciary agreements).

Outsourcing

Our team is ranked among the best outsourcing practice in Luxembourg. We advise on all aspects of Outsourcing, including regulatory (especially in the financial and insurance sectors).

The context of Outsourcing in the financial and insurance sectors is particular in Luxembourg. In addition to MiFID obligations, a specific legislation was introduced that applies to service providers who enter into outsourcing arrangements with financial institutions or insurance companies.

We have a sound understanding of the regulatory matters related to outsourcing, including the setting up of Support PFS (those providers servicing financial institutions).
